TERMS AND CONDITIONS OF USE

HOSPITALITY by Alvarez is the online store of the distribution company Alvarez Group.

1.1 This document describes the Contract Conditions to which the commercial transactions carried out between the owner of the Web hospitalitybyalvarez.com duly identified in the Legal Notice of the Web site and the purchaser (hereinafter, Client) of the products offered for a price through the ALVAREZ GROUP Web page are subject: hospitalitybyalvarez.com

1.2 The purpose of the Website is to make available to users products and machinery for the hospitality and food industry.

In compliance with article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we inform you that the owner of the website hospitalitybyalvarez.com is:

3.1 The owner of the Website may, at any time, modify the range of products offered and in particular the catalogues existing on the Website, both in relation to the products and to the prices, promotions and contracting conditions.

3.2 In principle, it must be presumed that the information on the conditions of purchase of the products offered on the Web is accurate and valid as long as it appears published on hospitalitybyalvarez.com

3.3 The products offered, their characteristics and their prices will appear on the screen in each case.

3.4 The product and contractual information offered on the Website is provided in Spanish. The formalisation of the contract and communication with the Clients will also be carried out in this language.

3.5 The products offered on the Website comply with the provisions of Spanish legislation. Customers whose domicile is outside of Spanish territory may be subject to rules other than those provided for in Spanish legislation. These Customers are responsible for verifying in advance the terms of the contract for products purchased through the Website, exempting hospitalitybyalvarez.com from any liability in this regard.

3.6 The products offered, together with their main characteristics and their price, appear on the screen. Álvarez Group reserves the right to decide, at any time, which products are offered to Customers. Thus, Alvarez Group may, at any time, add new products to those currently offered. Likewise, Alvarez Group reserves the right to withdraw or stop offering, at any time and without prior notice, any of the products offered.

4.1 To make any purchase on hospitalitybyalvarez.com, the customer must be of legal age. The customer must provide the necessary information for the contract; data that in any case must be true, accurate and complete about their identity and that the customer must expressly consent to by accepting the privacy policy.

4.2 The information provided by the Client during the registration process must be accurate, truthful and up to date. The Client shall be solely responsible for the consequences arising from any information provided by him being inaccurate, incomplete or false. If hospitalitybyalvarez.com finds that these circumstances have occurred, the Client's application may be cancelled.

4.3 It is also recommended that the customer print and/or save a copy of the conditions of sale when placing their order, as well as the receipt of receipt sent by Álvarez Group by email.

4.4 If a product requested and purchased by the Customer is not available, the Customer will be notified of this circumstance and offered a new availability or delivery date. If it is not possible to provide the purchased product, the Customer will be offered the possibility of cancelling the purchase if he or she so wishes.

4.5 The Client may request an invoice to be sent in electronic format. To do so, the Client must provide their Tax Identification Number. The Client will receive it by email to the address provided.

Orders will be delivered to the person and address indicated in the order, within the timeframes indicated on each product page and with the following costs:

Peninsula - €10 VAT included
Balearic Islands - €10 VAT included
Canary Islands - €30 IGIC included

*Free shipping on purchases over €300.

Orders will be delivered to the customer by courier or parcel companies. The order will be considered delivered when the carrier has delivered the package to the customer, and the latter signs the delivery receipt document. It is the customer's responsibility to check the condition of the goods upon receipt and to indicate any anomalies on the delivery receipt note.

No shipments or deliveries of orders will be made on weekends and holidays. The shipping areas are Spain Peninsula, the Balearic Islands and the Canary Islands . Orders outside these areas cannot be fulfilled.

The prices of the products listed on hospitalitybyalvarez.com will be expressed in euros (€) unless otherwise stated and will be guaranteed during the period of validity of these and whatever the destination of the order.

The VAT rate is 21%

Shipping costs:

Shipping costs will be borne by the customer. However, shipping costs may vary due to our promotions and special offers and will be informed at the time of purchasing the product.

Return costs:

Returns are associated with return and handling costs. The final cost will be communicated to the customer during the online purchasing process before the customer formalizes their acceptance.

a. By credit or debit card

You can make the payment immediately through the payment gateway using the secure SSL server of our banking entity (bancosantander.es). If it were necessary to make any return or cancellation of the order, the amount will be refunded through the same payment card, or by bank transfer to the account provided by the buyer. Both personal and bank details will be protected with all the security measures established in Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD). When placing the order, the customer will provide their card details, which will be stored directly in the Gateway during the purchase process. Alvarez Group does not store information regarding credit cards.

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract during a maximum period of 14 calendar days without having to indicate the reason and without incurring any costs, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the aforementioned text of the General Law for the Defense of Consumers and Users.

The customer will have a maximum period of 15 calendar days from the day of receipt of the requested good or product to inform Álvarez Group of their desire to withdraw from the contract. Withdrawal implies that Álvarez Group will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days (return policy).

During this period, the consumer will inform Álvarez Group of his/her decision to withdraw from the contract by filling out the withdrawal form and sending it to the email address. Álvarez Group will notify the consumer of receipt of said withdrawal. In order to proceed with the return of a product, it is essential that it is in perfect condition and with its corresponding original packaging and unused. Once we receive your request, we will contact the customer to provide the details of the return.

OBSERVATIONS: No product that has been misused, broken, etc. by the customer will be exchanged or refunded; otherwise, all guarantees will be lost. In the case of a defective product, shipping costs will be borne by Alvarez Group. In all other cases, these will be borne by the customer. If the product is in good condition, but the packaging (box, plastic or wrapping) in which the product is found is not in good condition, the return will not be accepted.

The consumer and user has the right to replace the product, or to terminate the contract, as established in Chapter II Title IV Book II of the General Law for the Defense of Consumers and Users.

Alvarez Group, as the party responsible for the website and in compliance with current regulations on the Protection of Personal Data, specifically Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Article 6 of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, we inform you that the data collected are: Name, surname, company, CIF, delivery address, email. These data will be included in the register of activities owned by the company in order to manage your orders, they will not be transmitted to third parties and no international transfers are planned.

The person responsible for the website undertakes to observe the obligation of confidentiality regarding the personal data that you provide us, to treat them confidentially and to store them by adopting the necessary measures to prevent their alteration, loss, treatment or unauthorized access, taking into account at all times the state of the technology, complying with the provisions established in the GDPR.

You may exercise your rights to access, rectify, limit, cancel and request data portability by sending a reasoned letter (with a copy of an official document identifying you) to the company's registered office.

Purchases of products made through the website are subject to Spanish legislation.

Should any dispute arise regarding the interpretation or application of these contractual conditions, the Courts and Tribunals established by the applicable Spanish legislation shall have jurisdiction to hear the matter. The parties expressly waive any other jurisdiction and agree to submit to the Courts and Tribunals of the city of Palma de Mallorca (Spain).
